Florida custody battle ends in mother's arrest for assault

Sometimes the fight for child custody extends beyond the courtroom. When parents take matters into their own hands, the results can cause even more complications or potentially even lead to jail time.

A 23-year-old Florida mother was charged with assault when a dispute over custody arrangements for her son led to a physical altercation between her and the boy's 25-year-old father. She was arrested after an Aug. 27 attack in which she assaulted the father with his own prosthetic leg.

According to the father, the mother sent him a text message earlier in the day, making threats on his life. At approximately 11 p.m., she arrived at his home to pick up their son. The father informed her that the child was not leaving the premises and that he would phone sheriff's deputies to keep her from taking the boy.

During the father's attempt to call the police, the mother allegedly took the child out of the home through a bedroom window and placed him in her car. The father followed her through the front door, at which time he claims he was attacked by two men. During this fight, the mother returned and somehow managed to remove his prosthetic leg. Allegedly, as the two men held the father down, the woman proceeded to beat him with the prosthetic leg. The father claims that she then returned to her vehicle, emerged with a shotgun and threatened to shoot him if he did not allow her to leave with their son. The mother was arrested and charged with assault with a deadly weapon without intent to kill, domestic violence battery, possession of a firearm by a felon and custodial interference.

Florida residents have a wide range of legal options when seeking to change their current custodial arrangements. The family courts will hear arguments when a parent believes that such a change is in the best interest of the child. It is important that, despite the strong emotions that custody issues can cause, parents remain calm and act within the parameters of the law to modify existing agreements.
